Fraudster found guilty and sentenced for contravention of Tax Administration Act

MPUMALANGA - Dlami Trading cc and Collen Mlungisi Nkosi, 43-years-old, charged with fraud, theft or alternatively contravening the provisions of Section 235 of the Tax Administration Act, the Prevention of Organized Crime Act, Act 121 of 1998 prejudicing the South African Revenue Service, causing an actual loss amount of R 950 090.07, finalised yesterday in the Specialised Commercial Crime Court in terms of Section 105 A guilty Plea, convicted, found guilty and sentenced as follows :

-Accused no 1: Dlami Trading cc sentenced to:

R 500 000.00, wholly suspended for 5 years on condition that accused is not convicted and found guilty again of Fraud or contravening section 4,5,6 & 8 of the Prevention of Organized Crime Act, Act 121 of 1998 and contravening section 235 of the Tax Administration Act, Act 28 of 2011 in the period of suspended sentence.

-Accused no 2: Collen Mlungisi Nkosi, director and sole member of Dlami Trading cc, in his personal capacity, sentenced to:

-R 140 000.00 or 5 years imprisonment of which R 100 000.00 or 4 years imprisonment suspended for 5 years on condition that accused not be convicted of fraud or contravening section 4, 5, 6 & 8 of the Prevention of Organized Crime Act, Act 121 of 1998 and contravening section 235 of the Tax Administration Act, Act 28 of 2011 in period of suspended sentence and further conditions:

-That accused no 2 Collen Nkosi to pay back the amount of

R 707 590.09 to the South African Revenue Service.

R 40 000.00 to be paid yesterday and the balance in instalments of Conviction and sentence:

R 3000.00 per month before the 7th of each month until the balance is paid off.

The sentence followed the arrest by the Hawks Nelspruit based Serious Commercial Crime Investigation on 08 March 2021 for fraud and theft after a warrant for his arrest was issued by the court. It was reported that in June 2017, the accused fraudulently submitted false Employee Tax Certificate (IRP 5) documents to South African Revenue Service, prejudicing the Revenue Service by claiming on behalf of his company, Dlami Trading CC, causing an actual loss of R950 090.07 to SARS.

The accused appeared before the Nelspruit Commercial Court today and he was released on R20 000-00 bail until he was sentenced today.

Trial was separated from the other six co-accused and their case was postponed to 1 June 2022 for their agreement to a Section 105 A guilty Plea.

The Provincial Head of the Directorate for Priority Crime Investigation Major General Zodwa Mokoena applauded the phenomenal drudgery by the investigating officer by arresting all eight accused and managed to link them until all pleaded guilty and convicted. She further alluded that the Hawks will do everything in their powers to bring every perpetrator before the court of law, she concluded.

ZF Mgcawu District bid farewell to one of their own

NORTHERN CAPE - The members of the South African Police Service in the ZF Mgcawu District gathered in Upington, on Saturday 28 May 2022 for the funeral service of Constable Felicia Bostander who was attached to Upington Border Police.

The Deputy Minister of Police, Mr Cassel Mathale, Acting Provincial Commissioner, Maj Gen Koliswa Otola as well as management from the National and Provincial office came to pay their last respect to the member who was also a member of the Northern Cape Provincial Netball team.

Constable Felicia Bostander was involved in a fire accident during her deployment in Postmasburg early this month and later succumbed to her injuries.

The Deputy Minister conveyed his sincere condolences and appreciated the contribution that the member has made to the organisation since she joined the SAPS in 2016.

Two SAPS members to face disciplinary action

ZWELITSHA - Two SAPS members are to face disciplinary action after they were arrested on Thursday the 26 May 2022 on R58 road between Aliwal North and Lady Grey for drunkenness at approximately 20km from Lady grey.

The arrests followed after the members were reportedly involved in drunken driving which is presumed to have caused an accident at a stop and go. It is alleged that the officers failed to stop and as a result, they almost run over two female personnel working at the road construction works in that area.

On arrival at the scene, police immediately arrested one Constable aged 31 for Reckless and Negligent driving with a state vehicle and both of them including the Warrant Officer aged 56 for being under the influence of liquor whilst on duty. The officers are stationed at Maletswai Police Station.

The Provincial Commissioner, Lieutenant General Nomthetheleli Mene wishes to thank the members of the public for their courage to report the unprofessional conduct of the SAPS members. "The conduct of these members goes against the spirit and letter of the SAPS Code of Conduct and is furthermore injurious to the image of the SAPS. Therefore, it cannot be forgiven. "The members concerned must deal with the consequences of their actions" said Lieutenant General Mene.

Western Cape police operations nets suspects on the wrong side of the law

WESTERN CAPE - Operation Restore members are making inroads in communities who are vulnerable to gang violence as they are ridding the streets of firearms in the hands of criminals. The members were busy with stop and search operations in Jacaranda Street, Ravensmead area last night due to ongoing gang activities when they searched a male and found him in possession of a semi-automatic uzzi. The 29-year-old suspect was arrested on charges of possession of an unlicensed firearm and resisting arrest.

Once charge the suspect will make a court appearance in the Goodwood Magistrates.

In an unrelated matter members of the Anti-Gang Unit arrested a 24-year-old male for the possession of an unlicensed firearm and ammunition in Lynstone Road, Hanover Park on Friday afternoon. The arrest followed after complaints of shooting in Hanover Park were received and the members were busy with crime prevention duties in the area. A 9mm CZ75 pistol and ammunition were confiscated.

The suspect will appear in the Athlone Magistrates court on Monday 30 May 2022.

Meanwhile Western Cape detectives conducted tracing operations during the week and arrested 635 wanted suspects on charges ranging from murder, attempted murder, assault with intend to cause grievous bodily harm, assault, business robbery, domestic violence, sexual offences and possession of drugs, burglary and robberies.

SAPS Mondeor members arrested two suspects for possession of an unlicensed firearm and ammunition

GAUTENG - On Friday 27 May 2022 members of SAPS Mondeor arrested two suspects, aged 29 and 34 years-old, on Lenasia Road in Eikenhof for possession of unlicensed firearm and ammunition.

The SAPS members were out on crime prevention duties when they stopped and searched a suspicious looking vehicle. An unlicensed firearm with ammunition was recovered.

The firearm will be subjected to Ballistic testing to determine whether it was used in the commission of other serious and violent crime.

The two suspects are expected to appear before the Booysens Magistrates' Court soon.

EC Provincial Commissioner expresses SAPS’ commitment to protect communities in the province

EAST LONDON - Eastern Cape Provincial Commissioner, Lieutenant General Nomthetheleli Mene assured the community of Home of the Legends, in a media briefing, that the South African Police Service is committed to protect every citizen of the Province against criminality, especially Gender Based Violence and Femicide that violates the rights of Women and Children. The Media Briefing took place at Blue Lagoon Hotel in Beacon Bay, East London on Friday, 27 May 2022.

Lieutenant General Mene encouraged a multi-agency collaboration to deal a hard blow to the foundations of the scourge of Gender Based Violence within all communities across the Province, regardless of geographical locality and status. "She further indicated the difference made by the SAPS forces in rural areas of Lusikisiki in ensuring safety of citizens, especially Women and Children.

The Provincial Commissioner expressed her concern about victims who are not reporting crime to the police, however committed to ensure crime awareness campaigns across the Province to talk to various communities about the significance of reporting criminality.

She utilised the platform to unpack Eastern Cape's Operation Sikhona that is making huge difference in the Province in fighting criminality.

Lieutenant General Mene concluded by making a call to the community to break silence on Gender Based Violence and Femicide. "I am making a call to all our communities to please not keep quiet about Gender Based Violence incidents. It does not matter whether it is not affecting you and your relative, we urge you not to be silent. Reporting helps us to make in-roads in these cases. We are committed to ensuring that our people are, and feel safe under our watch," the General concluded.

The MEC for Transport and Community Safety, Mrs. Weziwe Tikana - Gxothiwe, who officiated the Media briefing, reiterated collective efforts in fighting Gender Based Violence in the Province, and further urged all communities to play their critical role in ensuring safety in their respective communities.

Hefty sentences handed down to robber and murderer

MOUNT FLETCHER - The Acting District Commissioner, Brig Rudolph Adolph has gladly welcomed the sentence that was handed down by the Ntabankulu High Court at Mount Fletcher on 26 May 2022 to Saneliswe Phiwane, aged 23.

The accused was sentenced to double life imprisonment for murder and robbery and an additional 5 years for kidnapping and 10 years for defeating the end of justice.

It is now believed that on the day of the incident, 13 September 2020, the deceased, 37-year-old Nombuso Tlhatsi, fell in a trap of the accused to think that the accused wanted to propose love to her by exchanging telephone numbers while the accused knew exactly that he wanted to rob her of her motor vehicle.

Later on the day the accused contacted the deceased to meet her at a nearby open field.

The deceased arrived driving her Volkswagen Polo vehicle. After they had spoken for a while she was overpowered and then strangled to death by the accused using a rope.

The accused then placed the deceased at the back of the car and drove her vehicle heading to Mount Frere.

Upon arrival at Mount Frere, the accused dug a shallow grave at night along the Tina River between Qumbu and Mount Frere and buried the deceased.

The following day the accused together with his already sentenced co-accused were apprehended while loitering up and down with the deceased’ Motor Vehicle at Mount Frere.

His co-accused pleaded guilty during 2021 at Ntabankulu High court and is currently serving 30 years imprisonment, while this accused pleaded not guilty to all the counts until he was found guilty on all counts on the 26 May 2022.

The meticulous and professional investigation by the leading investigator D/ Cst Bulelwa Vakala and her team is applauded by the Acting District Commissioner Brig Rudolph Adolph.
