WESTERN CAPE - Nafiz Modack co-accused, Reza Van Oudtshoorn was sentenced this morning after entering into a plea agreement with the State.
Van Oudtshoorn pleaded guilty on a fraud charge at Cape Town Magistrate’s Court and was sentenced to a fine of R10 000 - 00 or twoyears direct imprisonment of which a further three years imprisonment that was wholly suspended for five years on condition that the accused is not convicted of fraud committed during the period of suspension.
Van Oudtshoorn admitted that on or about 03 June 2020, he unlawfully, falsely, with the intent to defraud and to the potential prejudice of a complainant, prepared and submitted on the request of Nafiz Modack an annual financial statement for the year ending 29 February 2020. This was allegedly done for Empire Investment Cars. The said financial statements are reported to have been based on information that was supplied by Nafiz Modack which were later presented to First National Bank, in support of an application for asset finance.
The Acting Provincial Head, Brig Trevor Hoys applauded the investigation and prosecution teams for outstanding efforts in securing the conviction.
